1. Acceptance of Terms

By accessing our website, mobile app, programs, workshops, or any related services, you agree to these Terms. If you do not agree, do not use our services. These Terms apply to both individual users and corporate clients.

2. Our Services

Activ-AR provides workplace wellness solutions including:

• Mobile app with guided exercise, stretching and wellness practices
• Corporate workshops (in-person or virtual)
• Training programs for injury prevention, ergonomics, and well-being
• Corporate health, participation and engagement reports
• Educational and motivational content for employees

Available features may vary depending on your subscription or company agreement.

3. Eligibility

You may use our services only if you are:

• At least 18 years old, or authorized by your employer
• Able to enter into a binding agreement

Corporate clients must ensure participating employees are authorized.

4. User Accounts & Conduct

Users agree to:

• Provide accurate account information
• Keep login details confidential
• Use the app and training materials respectfully and safely
• Not attempt to hack, modify, copy, or disrupt the platform

We may suspend or terminate access for misuse or policy violations.

5. Health & Safety Disclaimer

Our exercise and wellness content is developed by qualified professionals. However, all physical activity involves risk. You agree that:

• You participate voluntarily and at your own discretion
• You will exercise within your personal limits
• You will stop immediately and seek medical advice if discomfort occurs

Activ-AR does not provide medical diagnosis or treatment and is not responsible for injuries resulting from misuse or ignoring guidance.

6. Corporate Client Responsibilities

When Activ-AR services are provided to a company:

• The company is responsible for communicating participation guidelines to staff
• The company must maintain workplace safety standards
• Activ-AR does not replace internal safety officers or healthcare professionals

Corporate access ends if the contract ends.

7. Content Ownership & Intellectual Property

All content including videos, exercises, training materials, branding, software, imagery and documentation is owned by ACTIV-AR WELLNESS PTY LTD.

You may not copy, distribute, reproduce, re-upload, sell, or reverse-engineer any content without written permission. Corporate users may not reuse content beyond the agreed program scope.

8. Data & Privacy

We collect and process data to improve service quality, user experience and engagement reporting. We may use tracking technologies including:

• Google Analytics
• Meta Pixel
• LinkedIn Insight Tag
• TikTok Pixel

Data is processed according to our Privacy and Cookie Policies. Corporate reporting is aggregated and anonymous; we do not share personal health information with employers.

9. Payment, Billing & Subscriptions

Services and app subscriptions must be paid in advance. Subscriptions renew automatically unless cancelled. Failure to pay may result in service suspension. Refund rules are described in our Refund & Cancellation Policy. Corporate contract terms override general subscription terms where applicable.

10. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted or error-free operation, compatibility with all devices, or immediate support response times. We may update or modify features at any time to improve functionality.

11. Limitation of Liability

To the maximum extent permitted by law, Activ-AR is not responsible for injuries arising from exercise or wellness practices, nor liable for indirect, incidental, or consequential damages. You use the app and programs at your own risk. Activ-AR provides services “as available.”

12. Termination of Use

We may suspend or terminate access if Terms are violated, misuse or unsafe behavior occurs, payments are not maintained, or corporate agreements expire. Users may request account deletion at any time.

13. Changes to Terms

We may update these Terms when required. Continued use of services implies acceptance of the latest version.
